Can my husbands wages be garnished for this. I am unemployed since Oct. 2004 and we have no property together or separate. I did take out an additional card for him. I checked his credit report and there is nothing of this bank there nor is his name mentioned on the summons.

Crazy cat lady is right, credit cards are considered open accounts and in the State of New York the S.O.L. is 6-years, so if the accounts are older then that and you have not paid even a dollar on them or agreed that this is your debt, all you have to do is show the court that the S.O.L. has expired and the case will be dismissed.

If the company pursuing collections already has a judgment against you, then yes, your husband%26#039;s wages can be garnished. You need to find out whether there is a judgment already, and if not, then file Exception of Prescriptions into the case. You can fight this, if it has not already gone to judgment.
