Once one card is paid off, leave it open as an emergency buffer (also known as the broken fridge fund). Later, this will be replaced by a bank account buffer, but if you can get a credit buffer going, it%26#039;s more important to pay off your debt than to have a lot of money in the bank.



Then choose another card to focus on. (The next low balance or high interest card.) Take the minimum amount that you used to pay on the first card and snowball it into the payment of the second. Wash, rinse, repeat. This process is called snowballing.



Example:



Card 1 - 1,200 (minimum payment: 50)



Card 2 - 1,000 (minimum payment: 40)



Card 3 - 800 (minimum payment: 25)



Once you pay off Card 3, you can then pay 65 per month to card 2.



Don%26#039;t cancel the cards once you pay them off.



If you owe $30,000/$32,000 that%26#039;s a 93.75% usage.



If you pay off a $2,000 card it%26#039;s then $28k/$32k which is 87.5% usage.



However, if you close the paid off card it%26#039;s now $28k/$30k, which is 93.33% usage.



Keeping the card open but not used makes you look better, because you%26#039;re not as close to being totally maxed out. (Plus, that%26#039;s your emergency fund until you get you credit card payments low enough to make a savings account emergency fund.)



In all but the most dire situations, it is possible to pay off debt. This process will take a while, but it%26#039;ll be worth it!

If it was a legitimate court summons, and you failed to appear, they will enter a judgment against you. This means the creditor will have to file paperwork to garnish wages or seize any bank accounts.



YOU CAN NOT GO TO JAIL FOR FAILURE TO APPEAR OR PAY!



Your employer will receive a notice of garnishment and then they will inform you of the amount (average 25%).

Okay and it also seems like they gave you a chance to respond to the debt you owe but you didn%26#039;t so now it goes to court and you have the option of showing to discuss your case or not showing and they will then place a judgment against you. Jose, relax. Not paying your bills is not considered a criminal offense, and you will not go to jail.



Now, our previous responders have completely missed a major point here...you live in Texas.



Texas has laws that prevent credit card companies from garnishing your wages. They can attach a lien on your home, but they can%26#039;t just kick you out and see your home to recover their money. At best, they have to wait until you sell your home, and you have to pay them their debt at that time.



Please consult another attorney, as this guy is certainly out to jerk you out of $1500. At the very least he should have explained what I just told you.



And if you really do owe this debt, no attorney in the world is going to prevent a judgment against you.



And how much is this debt? Why would you pay an attorney $1500 to avoid a $2-$3000 credit card bill? If this were Michigan, I%26#039;d be sending a complaint to the local Bar Association about this guy.



So what to do? Based on the fact that this collection agency is going to have a mighty hard time collecting from you, give them a call and negotiate a settlement that:



1) Is at least 30% less then your debt



2) Freezes interest/late fees



3) Guarantees they delete this from your credit report



4) Has payments that you could manage.



Their alternative is to try and collect from you, which will cost them a lot with no guarantee they will collect a penny.

Paying off your credit card balance is a good thing to do. Yes it will help your FICO score,.



More importantly, you can use refinancing proceeds to pay off the card ( which is -what- at 30% or something like that ) and replace it with a 8% or so rate ( and the interest is Tax-deductible ).

Because you have excellent credit already paying off that credit card wouldn%26#039;t really help you. The only way that would really help you is if you are trying to eliminate some of your monthly bills besides you need to keep at least one thing open on your credit because that%26#039;s how we get approved for other things. They need to see that you have something on your credit you have been paying on for a while,and you have been paying on it consistently before they will approve you for anything else.

Did you check to be sure you have a judgment? Never take the word of a collection agent....call the court and find out.



To answer your question, they can not go after your husbands wages or property for debts you incurred prior to marrying him. But they can go after joint accounts and/or property, so be sure you are not on his bank accounts.

I would not worry about it. And if you are then call them and make arrangment. But most likley this is just a scare tactick. They are pronly not going to do anything. Alot of times they sell there old accounts to new companies to try and collect from you. You can also call and ask for a settlement price. most places after this long will settle for 50% or less of the actual balance. But I would not do anything unless they start calling you.

Since you are a homemaker and have no wages to garnish you might want to call and try to %26quot;settle%26quot; the debt for a lesser amount.
