If I file for bankruptcy on my 30k in credit card debt will they go after my house?

Considering i%26#039;m married, having just lost a job, and if i continue making payments on the house. Can they go after my wife閳ユ獨 savings or place a lean against our house which is in both our names?

Have you tried one of those %26quot;debt reduction%26quot; companies??? I know someone that did--an attorney run one. Slashed bills/monthly payment ALOT and be debt free in 27 months. You can build credit quicker after that....

If you file for bankrputcy you will have to declare what your assets are. If you have assets that your creditor might be interested in, they will certainly try to go after. You can file bankruptcy on your credit card debt, but with the new laws it will not be discharged...you will be required to file a repayment plan. If you fail to make your payments they can attach liens and siezures to any asset you have...



So if your name is on your wifes account they can go after it if you fail to make payments.



Also if your wifes name is on the credit card debt even as an authorized user (only if she made charges as an AU...even a 10 cent pack of gum counts) then she would also have to file bankruptcy to get the debt under the repayment plan.



The good news is that the repayment plans are a fraction of what you owe usually and you don%26#039;t accrue intrest while under the plan. You also should be aware that you are required under the new laws to complete 6 months of credit counseling in order to qualify to file bankruptcy.



When you file you do reaffirm on your home...so it would be as if you never filed bankruptcy on your home.

Really depends,



first in states like Florida your house is portected ( like the enron guys ) I am not sure if it is only protected if you own it ( you payed the bank back ).



also consider that there are stat laws that can change things . like in california your IRA is partially protected.



an other thing is to consider if $30k is even worth doing bankruptcy. consider just changing your phone number and throw the letters in a big bag.



there are helplines that you can call and offices you can go and see. Obviously they can only tell you certain thing ( they won%26#039;t tell you just to ignore it.)



well.. good luck... double check everything i said... do oyur own research... and be carefull about what people say to you. On this subject people go crazy for some reason. also remember that bad things only stay on your credit report 7 years but they can try ot collect in 20. Thing is they are credit card companies and they won%26#039;t try that hard. Also they each have to go after you separately ( unless there are like 8 different companies ( not cards ) then they can band together).



also you have the right (not sure if it%26#039;s a sate thing) to write to the companies and ask them to no longer contact you.

If you have more equity in the house than you do debt and exemptions, the trustee can sell the house to pay the creditors in part or in full. But if you file a chapter 13, you%26#039;d pay the equity in rather than lose the house. None of your credit cards could get a lien on your house unless they get a judgment and file it with the county clerk before you file.



AND YES, credit cards ARE dischargeable. Don%26#039;t let anyone tell you otherwise, when your bankruptcy is over you only pay on secured debts that you want to keep the collateral for, and nondischargeable debts like taxes and student loans. Credit cards don%26#039;t get that privilege unless they prove you committed fraud.



You should consult a bankruptcy attorney about whether it is a good idea to file with your house. If there is no equity and you are current it should not impact your house, but you really need to consult an attorney about this. If your wife doesn%26#039;t file and isn%26#039;t on any of the debts, she should be okay, BUT don%26#039;t go transferring lots of assets to her name just before filing. That is fraud, and a federal crime.



If you are honest about listing your assets and debts and follow your attorney%26#039;s instructions whether for a chapter 7 or chapter 13, you will get your discharge. If you have no job, a chapter 13 will not be possible, but if you cannot exempt most of the value of your home, a chapter 7 is a very bad idea.



Also, bankruptcies can stay on your credit report up to 10 years, though you can file again after only 8 years between chapter 7s, 6 years between a 7 and a 13 and 4 years between 13s.
