Wiil I go to jail if I don't pay my credit card debt?

I was served with a court order from a constable officer, but in the court order, was not a court date for me to go to, some time has past and I閳ユ獡 finding out that is too late or that I already past the time given to response when really there was not a specific time to response, and from friends I hear lots of stories about cases like mine and it looks like the same at the end, that they can閳ユ獩 do anything about it, my friends tell me if I can閳ユ獩 pay they can閳ユ獩 make me pay or put me in jail, but what about the court order thet realy did not have a court date? I went to a lawyer and told me even though it閳ユ獨 late he would charge $1,500 but will not guarantee anything ( I don閳ユ獩 trust these people it seems like they only want money and try to scare you just as much as these credit card companies )and also told me that this credit card company could eve put a lean against my home.

Is all of these true? I閳ユ獡 worry about, it should I be?

Thanks

Jose from Houston Tx.

If it was a legitimate court summons, and you failed to appear, they will enter a judgment against you. This means the creditor will have to file paperwork to garnish wages or seize any bank accounts.

YOU CAN NOT GO TO JAIL FOR FAILURE TO APPEAR OR PAY!

Your employer will receive a notice of garnishment and then they will inform you of the amount (average 25%).

Here is a link to explain the law in Texas

No...there are no debtors%26#039; prisons in the USA. Worst case scenario: The credit card firm gets a judgment against you, at which time they can garnish wages (I believe that wages cannot be garnished in TX)...or freeze your checking account.

NEVER, EVER be a %26quot;no show%26quot; in court....They%26#039;ll get a default judgment against you simply for not showing up.

Never heard that one before, I would suggest get a consultation from a lawyer.

It would cost you about the same to file bankruptcy. So if you have a lot of CC that you cant pay do that instead of paying that attny for that one card he cant promise anything about.

You won%26#039;t go to jail, but more than likely a default judgment order will be placed on you meaning they can collect by means of putting a lien on your property, freezing your bank account or garnishing your paycheck for the amount owed, but would be at about 25% until the debt is paid.

Okay and it also seems like they gave you a chance to respond to the debt you owe but you didn%26#039;t so now it goes to court and you have the option of showing to discuss your case or not showing and they will then place a judgment against you. You may can avoid this happening by calling the creditor and settling the debt.

Jose, relax. Not paying your bills is not considered a criminal offense, and you will not go to jail.

Now, our previous responders have completely missed a major point here...you live in Texas.

Texas has laws that prevent credit card companies from garnishing your wages. They can attach a lien on your home, but they can%26#039;t just kick you out and see your home to recover their money. At best, they have to wait until you sell your home, and you have to pay them their debt at that time.

Please consult another attorney, as this guy is certainly out to jerk you out of $1500. At the very least he should have explained what I just told you.

And if you really do owe this debt, no attorney in the world is going to prevent a judgment against you.

And how much is this debt? Why would you pay an attorney $1500 to avoid a $2-$3000 credit card bill? If this were Michigan, I%26#039;d be sending a complaint to the local Bar Association about this guy.

So what to do? Based on the fact that this collection agency is going to have a mighty hard time collecting from you, give them a call and negotiate a settlement that:

1) Is at least 30% less then your debt

2) Freezes interest/late fees

3) Guarantees they delete this from your credit report

4) Has payments that you could manage.

Their alternative is to try and collect from you, which will cost them a lot with no guarantee they will collect a penny.
