I am now divorced and two years ago my ex and myself signed a property settlement agreement. In that agreement she got the house completly although I should have been entitled to half the equity. She couldn%26#039;t come up with the cash to pay me off directly so the deal was made that instead of cash she would agree to pay off a credit card debt leftover from the marriage and allow me some tax deductions from our children for a couple of years. The settlement states this fact an was signed by the judge as well as both of us. She has failed to pay off this debt and I still get hounded by the creditors. Am I still liable even if I have a signed legal document saying she accepts all of the debt?
Credit debt left over from a divorce?
Yes, you%26#039;re still liable. The credit card company didn%26#039;t sign the agreement, and since your name is on the credit agreement, you%26#039;re liable.
You need to talk to an attorney...but basically you need to get a court to enforce the divorce agreement so she%26#039;ll pay YOU that money, but you should pay off the card to keep your own credit in good shape. Then get a court order to attach her wages to pay you back for what she should have paid.

You are liable to them. She is liable to you for what they get from you. Joint and severable liability I believe.
Also make sure that you keep those docs. Those can help you if that causes you to not get approved for a car or home loan.
Credit debt left over from a divorce?
You shouldn%26#039;t be. Contact a lawyer to find out what your rights are. In the meantime, explain to the creditors what you posted here. Fax or mail them documentation if needed. They probably won%26#039;t excuse the debt because it%26#039;s in your name, but if you are persistent, they may be more willing to work with you.

You should present your case to the creditors and file your statements with the three credit bureaus.
Perhaps, you should look into getting an attorney to fight your ex on paying her share or sell the house to pay for what she agreed.
Credit debt left over from a divorce?
Yes. The creditors never made an agreement to accept less. Just because your marriage ended does not give you license to shirk your responsibility to companies that made loans based on YOURS and your exes promise to repay. That being said, you can sue your ex civilly for failure to uphold the judge%26#039;s order pertaining to property settlement. Easy solution? If you have the money, pay the creditors something as a one time settlement to release you. Then it will be left totally to your wife. Make SURE YOU GET A RELEASE OF OBLIGATION FROM EACH CREDITOR IN WRITING.

I think this depends on the state, but what you can do is send a copy of the documents to the creditors to see if they will back off. If not, file a dispute with the three major credit bureaus and have the documents attached as a consumer statement. That way, anytime someone pulls your credit, those statements will show up as well to explain in negative entries.
If all else fails, you can get a law firm to send letters to credit bureau requesting they remove the negative entries based on the evidence in your signed documents.
If your credit is already ruined by this, then don%26#039;t even try to pay the creditors. Your credit won%26#039;t get any worse and that admits to the creditors and the court that you still accept responsibility for the debts. Which you should not if you have a signed agreement.

You should save yourself from headaches. There is no discount in stress. You should find a lawyer that will take care of your problem with getting this resolved. This lawyer must write it out as to what the cost is for what you need done. First, you need to send a copy of the initial judge%26#039;s decision to the three credit bureaus. Please send a copy of what present resolution you get, from the lawyer%26#039;s participation, to the three credit bureaus. Read Psalm 35 (Plead My Cause) - It is long but it is worthwhile.
Read Psalm 4 for (Protection and Safety).
You should have no problem with bad outside forces.
God Bless
