I have credit card debt and the credit card companies are threating to take me to court. Can they do

I am thanking about going bankrupt and I have talked to a lawyer and he told me not to pay anything. I was just wanting to know if they could do anything. I know they can take your wages. How long does it take for something like that to happen?

You need to tell the Credit Card Company you are planning to file a bankruptcy. Then you should get moving on the bankruptcy. It would take the credit card companies awhile before they could be garnishing your wages, and you would know it was going to happen because you would receive a summons and court date. If you are planning on filing just do it, if you don%26#039;t know if you are you better make arrangements with the credit card companies.

You go to court and tell the Judge you can only pay xx amount.



That is then fixed, they CANNOT ask for or take any more.

But what you folks don%26#039;t seem to realize is that I and everyone else pays for your mismanagement of money. You%26#039;re only penalty is you get a bad credit rating for several years. We and our kids pay for this forever. I suggest you seek professional help from counselors to help you manage your money better.

1st of all bankruptcy should be your very last option!



Should your creditor take you to court, it would be in your best interest to meet them on the court date and attempt to work out a financial solution with them. Then, you MUST keep up on the arrangements! If not, then they can take you back to court to get a wage attachment/garnishment.



Further, at this point I do not agree with the attorney. I would try to work something out with the creditor UNLESS the statute of limitations has run out for your state.

They can%26#039;t do anything unless they sue you. If they sue you they will probably get a judgment for the entire unpaid balance, plus late charges and interest, etc., and also for their attorney%26#039;s fees (if the agreement says so). Once they have a judgment, they can garnish your wages, and leave you with basically only the minimum wage. They could also try to %26quot;attach%26quot; your personal property such as a car that has good value and no loan on it, and have the sheriff auction it off. They can only do these things if they get a judgment first.



The unpaid credit will be on your credit report and make it very difficult for you to qualify for a new loan from anyone.



If they sue you, filing for bankruptcy will automatically stay their lawsuits. Bankruptcy can, however, ultimately erase those debts forever so you can start over.

Sounds like you are already past the point of no return so Go ahead and let them take you to court ( you will see that the credit card companies will balk at the last minute)



Just make a deal with them for a reasonable amount to be paid every month and they will leave you alone- communicate is the key!



No after reading some Posts I agree Bancruptcy Is a good option! see a lawyer first if you can and if he / she says it is in the bag then stop paying all your bills! use that money for the lawyer and file Bancrupcy! The sooner the better!



I was in debt for 10 years before I filed and My life would of been 1000 times better had I filed sooner!



The only credit card company that was willing to work with me was Bank One and bless them for having a way out for me and If the other Crappy credit card companies and auto leanders had a program like Bank One I would of NEVER FILED! so screw em and feed them fish heads!

They can force you to go to court.



If you go to court and they win, they get a judgement. With the judgement, they can force you to pay. They can force you to sell assets, garnish your wages, or stick to a repayment plan. Exactly what is done is up to the judge, but they won%26#039;t make you pay so much you can%26#039;t afford to eat.



If you have an attorney, I would take his advice. If he is experienced in bankrupties, he should know what he is doing and should be able to protect your assets.

Unless your total debt is so overwhelming you can%26#039;t possible manage, bankruptcy is not a good idea esp under the new law.



Since you have talked to a lawyer (who of course WANTS you to file since that is how he earns his fee) you might also want to talk to the local Consumer Credit Counseling and see what they have to say. If BK is your best option, they will tell you.
