Hey, I just was wondering what happens to you (or me in this case) when you have to go to court for a debt that you can not pay ? I have a court date set next week. I have been paying off some old credit card debt, school loan and old car loan debt. All I had defaulted on about five years ago. Many of my debts I%26#039;ve been put on repayment plans and have kept those up to date but there are some that are always serving me papers and threatening letters from lawyers. I work and l gross only about $17,000 a year, I just don%26#039;t have any more money, and to make matters worse, I just got laid of five weeks ago. I%26#039;m just not sure what to expect and I%26#039;m a little scared to go to court but, at this point I have no other choice. I know laws are different so I%26#039;m in Florida if this helps. First you need to figure out how long ago the last activity was on this account. If it was a credit card, when was the last payment or charge. If it is more than 4 years, in Flordia then the statute of limitations have expired for them to file suit against you.

File a motion with the court to have the case dismissed based on the statute of limitations or make the arguement when you go to court.

If you are the Head of Household, Flordia does not allow them to garhish your wages. There are also other personal and real properties that they cannot touch.

You need to do some research prior to going to court and get your ducks lined up on the arguements you will present in court.

i would imagine that a judgement will be entered against you. Its probably a blessing that you got laid off. The credit company doesn%26#039;t know where you will be working in the future, so they won%26#039;t be able to garnishee your wages.
