ok, this is my situation, i owe 475 left to mastercard, i fell really behind and then a collection agency called, last month i made 2 x $100 dollar payments, all the while, he was saying well, if u dont pay ur account in full its going to the lawyers. so i made the 2 payments, which brings my balance to 475$ he called again this morning, and i told him, the next payment would be next wendesday, of 150$ and he said he needed the balance in full by 3 o%26#039;clock today and if not next tuesday someone would be in touch with my work and then they would start taking 30% of my pay... so my questions are, can they take some of pay or is that just a scare tatic, is he allowed to call me at work, he calls my house, and i answer to him here, but if i miss his call he will call me at work, and that is embarassing, can i ask him not to call me there, also its not a crazy amount and i am doing my best is he allowed to tell me to borrow from a family member, because thats what he told me to do. thanks

If you tell them not to contact you at work, considering they have already contacted you at home, if they do in fact call your job they are in violation of the Fair Debt Collections Practices Act. In order for them to in fact garnish your wages, you must live in a state that would allow that kind of judgement. If that is the case, they would have to sue you first, then win the case, then seek judgement (garnishment, lien, bank account seizure). All of this takes time, quite a bit of time and if you only have under $500 left to pay, don%26#039;t worry about being sued too much. You will be able to pay that amount long before the process would get started. It is in fact a scare tactic, one that if they fully intend to NOT sue you, is again in violation of the law. I would suggest you make sure any payments you are sending you send return registered receipt from the post office and you make copies of those checks. It would have been best to just wait it out and make one payment in full, but since you have already been paying continue that. Unfortunately it wouldn%26#039;t be hard for them to just simply say you haven%26#039;t made a payment. This is a collection agency you are dealing with, all they want is money and more of it, they will do whatever and scare you into giving more but for that amount it would cost them to even bother trying to sue you. Also you should tell them that any contact should be made in writing (always leave yourself a paper trail). Learn your rights, you are doing the right thing by paying the debt so don%26#039;t let a bottom feeder violate those rights. If you are making an effort to pay, they should work with you. It just depends on the company. Yes you can tell them not to call you at work, that borders on the lines of harassment. And no he can%26#039;t tell you where or how to get the money, just be firm with them and try your best. Good luck!

It%26#039;s why your credit card company ups your limit when you are already in debt. It%26#039;s why you get so many solicitations in the mail offering you a new credit card.
