i received a summons 2 months ago without a trial date it stated i had to reply in 30 days i replied saying that I would pay 30 dollars a month to try and settle but I have heard nothing back from them I also told them in my answer that I did not have a job but would try and pay the 30 dollars a month with the money my son%26#039;s father gives me which is not court ordered but he just gives me enough money for my son%26#039;s needs and thats it I have not heard anything from the lawyers or the company I have no stable address or phone number so I don%26#039;t know if they have tried to contact me the police brought the paper and gave it to my friend I was wondering if I should call them and see what%26#039;s going on or just wait until they accept my 30 dollars any advice also I live in Georgia. Please no smart comments I fell into some bad luck over the past few yrs and don%26#039;t need any negative comments about paying my bill off that I know I owe

A summons without a trial date is not a summons at all; it%26#039;s a scare tactic done by bill collectors to snare the unsuspecting.



The police do not deliver summons; this is a civil matter, not a criminal one. A constable _might_ do so but still would not give it to a 3rd-party - legally he CAN%26#039;T give it to a third-party. So... who was this person who gave this piece of paper to your friend? I seriously doubt he was wearing a uniform; what exactly did he say?



Here%26#039;s the deal; pay what you can each month and pay careful attention that the checks are cashed. Be certain the account number is referenced in the memo field on your check. Call the company and see if you can get them to suspend the late charges and interest. Whether they say yes or no, get them to commit that decision in writing and send it to you (whatever address you can come up with). If they will not suspend late charges and interest, then tell them nicely that you are able to service the account only if it is frozen from further charges. Point out you are unemployed and doing your best to work with them. If they find that unacceptable tell them (politely) to shove it up their left nostril. Save all documentation.



Now.. when you get a REAL summons, you take it all to the judge and point out you were unemployed but doing your best. But 30/month, which was all you could do and was taking food out of your baby%26#039;s mouth, would not pay off the account because the company refused to work with you by freezing the account (i.e. stopping all late charges and interest). The judge will most likely call on them to do so and THEN you can pay off the account; it%26#039;s not like you%26#039;re ignoring the debt, you just need them to work with you.

There is no debtor prison in the USA or other countries. You can ignore debt and they can do nothing except take your credit away.



You just need to ignore it all... they like to pull your chain.

pay as much as you can every month, even if its just a penny, they have to take it and then they cant press charges, not that they would anyways, there are a lot of people who are worse on their credit cards and their payments. the only thing you want to avoid is them sending it to collections. good luck i really hope things turn around for you.

You should contact the company directly and make sure that you keep everything in writing. If it is going through the courts than the money owed has probabley already been turned over to a collection agency. Try to find out which one from the company that you originally owed the money to and contact them.



They don%26#039;t care what your financial situation is, but they should be willing to negotiate a payment plan with you. You will need a stable number that you can be reached at before this can be done.



Do not talk to theit lawyers as you may be charged additional costs for this.



If it does go to court, you may be found responsible for court and attorney fees.



Police are usually only permitted to give notification papers to you directly as it is the only way that they can ensure that you have been served the notice. Why was your friend given the papers?



There are usually credit counselling centres available free of charge who may be able to help you. Check your phone book.



If anyone sends you negative responses, ignore them. Everyone at some point has hit a low spot and instead of ignoring the situation as many would, you are doing your best to try to sort it out. I hope that things improve for you and your son in the future.
