I have about 30k in cash laying about in a low interest account (3%). I could use this to pay off my credit card debt of about 5k or pay down my student loans (40k - private@8%). Additionally, since prices in my area have come down I could use this to pay into a mortgage (no greater than 200k). With so many options which way should I go?

Pay off your student loans next (maybe about $15k of it), leaving enough of an emergency fund for when **** happens (because it will).



Housing prices WILL continue to come down over the next year or so, I wouldn%26#039;t rush into home ownership just to have property. It could take that long to find something you like as well.

I would first pay off your credit card since it should be at a higher rate than the private student loans. Than I would put 5 to 10K towards the student loans and spend the rest to help buy a house. This way you have no credit card debt, you have paid down your student loans so that you will pay them off quicker and you get a house so it is a triple win.

Try and get a no money down mortgage, pay off the CC, and never pay down the student loans. Screw em. Give them $90 for the rest of your life. If you can%26#039;t get goo loan than you would need to put down 10% and than you can still pay off your CC. The CC is the biggest bruiser. First you need to figure out how long ago the last activity was on this account. If it was a credit card, when was the last payment or charge. If it is more than 4 years, in Flordia then the statute of limitations have expired for them to file suit against you.



File a motion with the court to have the case dismissed based on the statute of limitations or make the arguement when you go to court.



If you are the Head of Household, Flordia does not allow them to garhish your wages. There are also other personal and real properties that they cannot touch.



You need to do some research prior to going to court and get your ducks lined up on the arguements you will present in court.

Yeah-- don%26#039;t fall for that %26quot;consolidation%26quot; stuff. It%26#039;ll damage your credit.



It%26#039;s all about the interest rate. Figure out what interest rate you are paying on your cards and try to get the balance(s) all transferred to the lower rate.



A lot of credit card companies try to get you to use them by hooking you in with a zero or low rate for balance transfers. Get one of these offers and transfer all your balances to it. And don%26#039;t put any purchases on that card! If you put a purchase on it, the zero interest rate no longer applies and won%26#039;t until the entire balance is paid off.



You might not be able to get another card. If not, just pay the larger interest cards off first. If interest rates are the same, it doesn%26#039;t matter if you pay on a bunch of cards or one-- you end up paying the same. It%26#039;s a hassle to make more than one payment, though.



Just play the rates-- pay higher rates off first; shop around for transferring to a lower-rate card or offer.

With several cards I don%26#039;t think it would be practicle to go with another credit card and rolling over debts. I think a consolidation loan may be better.



If you have a home, can you access any equity? A home equity loan has lower interest rates, and the interest is tax deductable.



If you have enough disposable income, it would obviously be much better to try and work out a serious budget. Take every dime you can and pay off the cards. Start with the high interest cards first, then work your way down.

Sounds like you need to sign up for financial education classes. Are you one of those people who thinks they must have money in the bank because they still have checks? C%26#039;mon! Now, on a different note, even if you reneged on an appropriate offer of settlement, with your debt of $995, most of that is probably interest and fees. I will bet that most %26quot;good%26quot; collectors will still work out a reduction or an acceptable installment payment plan with you. What you need to do, is talk to another collector or supervisor. Explain %26quot;respectfully%26quot; what happened last time and that you overstepped your capabilities. Then negotiate a plan that you can actually handle or live up to. They are not truly interested in litigating a small debt like this if they don%26#039;t have to. If they do, you will incur substantially more fees and costs and inability to pay is NOT a defense. So do your best to work out another deal with this collector or his/her supervisor.

Talk with her supervisor. You are trying to make arrangements and it sounds like they did not follow promptly on their end. Next time get the agreement in writing and send them a check.

Well i dont feel that sorry for you, you told them it was okay to take it out of your account, so you knew it would happen sometime soon, you shouldnt have spent that money, if you needed it for rent, etc. you should have thought about that before hand and set up a payment plan instead. Usually you can talk to the people who actually sent the debt to collections they can also give you a lower payoff amount.

Tell them right off that you will pay them but unfortunately THEY NEED TO WORK WITH YOU.

I back-tracked their company info and the name of our rep to a call center in Phoenix (near where I used to live) so when that final payment comes due I%26#039;m going to do my damnedist to go down there and hand them the check in person... Just to let them know that if they keep bullying and screaming that it isn%26#039;t that hard to find out where they are... and that they are lucky that I%26#039;m a nice person because the next person that they drive to insanity might not be so cool...

You would want to get in with a company that is non profit as you stated in your question. Other companies charge you a fee for doing this for you, as much as 50.00 a month. Consolidated Credit Counselors is a company I used before the only problem I had with them is the agreement they have with the issuing banks it to make payments that is 5% of what you owe. That was too high for me so I had no other choice but to do a bankruptcy. In time your credit rating will improve. But by taking action and just not walking away will definately improve your credit rating.

I recently enrolled in a program with a company called Debt XS (www.debtxs.com). What you do is stop paying on your credit cards (which will hurt your credit) and start paying into a personal savings account of your own. You keep Debt XS informed of the amount you have saved and when your account gets high enough they will call your credit card company and negotiate an amount to pay to the credit card company to consider the account paid off. Once you pay the amount agreed upon (which you pay directly to the credit card company) it will go on your credit report as settled then you can start to work on your other accounts. It will damage your credit but once settled shouldn%26#039;t take as long to repair the damage as bankruptcy. They claim that the credit card companies usually settle their claims at half of what you owe, but there are no guaratees. I had tried everything else and figured the amount they were charging to help me out is peanuts compared to what I was paying in interest. It%26#039;s definitely something to look into. They are very helpful and will explain everything involved in their program that way you can make an informed decision whether or not you want to go that route. I%26#039;ve only been with them for about 4 months so I haven%26#039;t gotten anything settled yet. The worst part for me has been the credit card companies calling and hassling me for payment constantly (at least 4 times a day). All I know is that bankruptcy isn%26#039;t an option for me. I tried talking with the credit card companies to get a lower interest rate but they wouldn%26#039;t work with me. I tried to consolidate and no one would do that either. You could also try a credit counseling agency. They negotiate with the credit card companies to get a lower interest rate. You then pay the credit counseling agency and they disperse your money to your credit card companies for you.

Obviously, you should not have given him access. I see a couple options:



1. Call the credit card company and cancel it. If you cancel it the day after payment is due, his balance won%26#039;t be too high.



2. Call the credit card company and ask for a reduction in your spending limit.



3. Talk to him and ask him to get his own card.



4. Ask the credit card company, in writing, to take your name off the card. I don%26#039;t think that they%26#039;ll do it, but it would be a good letter to have later.

Unfortunately, if you take the card away and remove him from the account and he does not pay....you are responsible for the debt since you are the primary account holder. Under no circumstances do you put someone on your credit card account or do you co-sign a loan for anyone! I learned the hard way and I can see that this will be a valuable lesson learned for yourself. It is a sad situation and I am sorry to hear that your friend went way out of bounds by charging the card to the max. This is a terrible situation for you. If he stops paying you are the one responsible to make the payments. You need to have a face to face with him and try to get him to admit he%26#039;s the one liable for the charges and then get him to sign an agreement, written by you to that effect. That way you would have recourse in a civil suit if that becomes necessary. Did he charge anything that you can take possession of? TV, computers etc. It doesn%26#039;t sound good for you. I had an ex-girlfriend do the same thing with my money. Best thing I did was take all bills / statements / payslip to Citizens advice bureau. (CAB) - they will write to creditors suspending charges and working out a realistic repayment plan. Works with all debts exceot HFC who ignore all letters. (that%26#039;s not a gripe, they%26#039;re known for it.) - HFC debt will eventually get written off. The alternative is to pay a debt management company to do the same thing, but CAB do it free.

Do not Go for any Debt Managment companies, as they charge you for the advice.

Ring the companies, don%26#039;t put it off and see if you can come to an agreement as to a payment you can make each month. If you really can%26#039;t afford anything or that doesn%26#039;t work phone the CCCS (Consumer Credit Counselling Service). Type them into google for the website or phone 0800 1381111.They are a registered charity who do the same thing as a debt management company. They usually help you find a way to pay the companies without getting a CCJ and will do a budget with you etc. However chances are you will have already have damaged your credit a bit by having late payments on your record and if you have been referred to debt collection agencies default notices too.

You intentionally committed fraud. If you were in the U.S. you can go to jail for this. I dont know what the law is in the UK but if someone starts investigating and puts 2 and 2 together, they will figure out you did it intentionally. But if you start paying right now, theres a good chance they wont investigate. They probably wont do much about the credit card but you dont want to get in trouble with the banks. Bad credit is the least of your concerns. Here they would probably give you 2 years in jail and UK law USUALLY isnt that different from US law. You better start making payments and hope they dont investigate you

what i did when i was in debt is tell them i can only afford 鎷?0 a month to each of them (or more if you can afford it) and if they say its not enough then send them a monthly expenditure lay out saying what your money goes on and what you have left at the end of the month. make it more than you spend if you need to. like extra on food shopping or travel, buses, tubes, trains, petrol. they don%26#039;t check.



if this comes to nothing and you aren%26#039;t working then you can get legal aid and a free solicitor who will write to the company asking for the interest to be stopped and offering a repayment plan. i did this and it worked.



if you are working, i think everyone in the country is entitled to one free session with a solicitor to give you advice.

Currently my credit cards have a rate 3-5 percentage points above that. I am 30 years old and contribute the max to my 401k. My feeling is that I might as well be paying the interest to myself instead of to the credit cards. Also I am 25-30 years away from retiring. I can use the money I save from paying my credit cards each month and start a Roth IRA and/or invest it in mutual funds and stocks as well as college plans for my daughter. I also have money in mutual funds that I could liquidate to pay my credit cards. What do you think is the best option? 1. It could be a scam



2. The company has to write the forgiven debt off. But in order to write off forgiven debt, it has to know how much of the debt is forgiven. Therefore, they take the money you give them and subtract it from the total owed. Then, they generate an invoice for the new balance and that new balance is transferred to a different account. Sometimes, a statement is sent to you as a result of the regular billing procedure.



3. The money you paid could have been credited to the wrong account.



Contact the company that arranged the settlement and ask them to look into this.

If you have concerns about debt (either yours or his), then the best thing to do is sit down and create a plan for getting out of debt that you are both comfortable with. You are marrying this person, so in a broader sense, his problems become yours- it%26#039;s up to both of you to work it out together. A write off is just that - they have written the debt off as uncollectible. Do not let anyone tell you anything else. I%26#039;ve been there. Contact the company you originally owed and let them know that you will not stand for the harassment. The cannot legally collect a debt they have written off.

Probably better that you talk with the creditor than your wife, since you had nothing to do with the original purchases that created the debt.

I have a judgment against me from the second mortgage holder on an investment house I bought that was foreclosed on. The first mortgage company foreclosed and sold the house (in Nevada) at auction. If you have alot of assets......non retirement assests (because those are protected), then you may have to file chapter 13 which would help you reorganize your debts and set up a plan to pay them back at a reduced amount and interest rate. Basically you end up with a CCJ, and the judge orders you to pay. It ruins your credit rating! You can put in a defence though with your incoming and outgoing money, and the judge will only order you to pay what you can afford, can be as small as 鎷? a week! So sometimes, although it ruins your credit, it can be a blessing, as you are ordered to pay less than what the credit card company would want you to pay.



It is better to try and make an arrangement with the company yourself though, and save your credit rating. Its not really worth companies taking you to court for small amounts of money, but they threaten it to try and get you to pay. I`m sure that you can come to a private repayment arrangement at a monthly fee you can afford. If you set this up though, its VITAL that you stick to it!

Firstly, well done you, for facing this and handling it even though you are so ill. You are handling things the right way, they could take you to court if they wanted to, but would look pretty stupid as you have offered monthly payments and you are paying your creditors back. Having been in exactly the same situation as you, I can tell you the thing to do would be to visit your local Citizens Advice Bureau and take all your paperwork with you and let them help you. They know the law, and what the minimum payments you could make, which may buy you a little more money after creditors are paid off. They are non-judgemental and really helpful, explain everything to them and you won%26#039;t be sorry you went to see them, they will put your mind at rest.



I can also recommend having some Cognitive Behaviour Therapy for your depression. I was dogged with severe depression for over 20 years, I had all kinds of treatments and therapies, all to no avail, but I had six sessions of CBT two years ago and have not been depressed since, it gave me control over my life again, your doctor should be able to refer you. You can see a debt advisor at citizens advise for free. they will negotiate with these companies for you, personally i think they will negotiate that you will pay far less than you have offered considering your income.



The worst that happens if it does go to court (and it`s only county court) is that you will offer to make repayments and the y will have to accept it. Don`t worry nothing ever turns out as bad as you think it will. Theses people are employed to threaten and bully you, they get bonuses for it!

You might consider a consumer credit counselling service. Such services will take the info on your debts and income and try to work out deals with your creditors for you, and help you come up with a budget as well. Just be sure that you don%26#039;t use one that will want to loan you money, and check with your state%26#039;s attorney general%26#039;s office to see if your state licenses credit counselling organizations. Many are not reputable.
