Then choose another card to focus on. (The next low balance or high interest card.) Take the minimum amount that you used to pay on the first card and snowball it into the payment of the second. Wash, rinse, repeat. This process is called snowballing.



Example:



Card 1 - 1,200 (minimum payment: 50)



Card 2 - 1,000 (minimum payment: 40)



Card 3 - 800 (minimum payment: 25)



Once you pay off Card 3, you can then pay 65 per month to card 2.



Don%26#039;t cancel the cards once you pay them off.



If you owe $30,000/$32,000 that%26#039;s a 93.75% usage.



If you pay off a $2,000 card it%26#039;s then $28k/$32k which is 87.5% usage.



However, if you close the paid off card it%26#039;s now $28k/$30k, which is 93.33% usage.



Keeping the card open but not used makes you look better, because you%26#039;re not as close to being totally maxed out. (Plus, that%26#039;s your emergency fund until you get you credit card payments low enough to make a savings account emergency fund.)



In all but the most dire situations, it is possible to pay off debt. This process will take a while, but it%26#039;ll be worth it!

If it was a legitimate court summons, and you failed to appear, they will enter a judgment against you. This means the creditor will have to file paperwork to garnish wages or seize any bank accounts.



YOU CAN NOT GO TO JAIL FOR FAILURE TO APPEAR OR PAY!



Your employer will receive a notice of garnishment and then they will inform you of the amount (average 25%).

Jose, relax. Not paying your bills is not considered a criminal offense, and you will not go to jail.



Now, our previous responders have completely missed a major point here...you live in Texas.



Texas has laws that prevent credit card companies from garnishing your wages. They can attach a lien on your home, but they can%26#039;t just kick you out and see your home to recover their money. At best, they have to wait until you sell your home, and you have to pay them their debt at that time.



Please consult another attorney, as this guy is certainly out to jerk you out of $1500. At the very least he should have explained what I just told you.



And if you really do owe this debt, no attorney in the world is going to prevent a judgment against you.



And how much is this debt? Why would you pay an attorney $1500 to avoid a $2-$3000 credit card bill? If this were Michigan, I%26#039;d be sending a complaint to the local Bar Association about this guy.



So what to do? Based on the fact that this collection agency is going to have a mighty hard time collecting from you, give them a call and negotiate a settlement that:



1) Is at least 30% less then your debt



2) Freezes interest/late fees



3) Guarantees they delete this from your credit report



4) Has payments that you could manage.



Their alternative is to try and collect from you, which will cost them a lot with no guarantee they will collect a penny.

Paying off your credit card balance is a good thing to do. Yes it will help your FICO score,.



More importantly, you can use refinancing proceeds to pay off the card ( which is -what- at 30% or something like that ) and replace it with a 8% or so rate ( and the interest is Tax-deductible ).

The only way that would really help you is if you are trying to eliminate some of your monthly bills besides you need to keep at least one thing open on your credit because that%26#039;s how we get approved for other things. They need to see that you have something on your credit you have been paying on for a while,and you have been paying on it consistently before they will approve you for anything else.

I would not worry about it. And if you are then call them and make arrangment. But most likley this is just a scare tactick. They are pronly not going to do anything. Alot of times they sell there old accounts to new companies to try and collect from you. You can also call and ask for a settlement price. most places after this long will settle for 50% or less of the actual balance. But I would not do anything unless they start calling you.

I would be short on cash after paying the essential bills such as house payment, car payment utilities, etc. Then something unexpected comes up, like a hugely expensive car repair or something in the house breaks down, so I would use the card for that. All the bills are paid, but my family hasn%26#039;t been fed yet, so I would go to the grocery store and get what we needed. Have to have gas in the car, so there goes another $40. Then I would get paid, only to find I had another big bill due that would wipe out most of my check. So there I am, broke again, and only the credit card to live on until next payday. Repeat this process monthly for a couple of years and you find yourself deep in hole that you can%26#039;t get out of. I%26#039;m not sure what%26#039;s going to happen next, but I have come to realize that you don%26#039;t have to be a bad person or live an extravagant lifestyle to have bad credit. I don%26#039;t know if they will come after him but if he thinks that running from this debt will absolve him from it, he is mistaken. Lenders sell their debts to other companies to collect. I don%26#039;t know if credit card companies do that, but that debt isn%26#039;t going to go away.



The best place to check this out is to look at the card%26#039;s web site. You can even call and ask a general question. I doubt that they will track you down. Give a false name.



Ask your son who he thinks will pay for the debt he amassed? Does he realize that there are other people who use this card who don%26#039;t want to have to pay fees to use it? Does he realize that he used the products and services he paid for with this card and that what he is doing is stealing?



This is really a moral issue and an issue of maturity. I hope you can help him see where his duty lies - to pay off this debt before he amasses any other.

What do you mean take care of it?



Your best bet is to pay it off. Start with the highest interest rate card first. Basically what you do is make minimum payments to all cards and pay the highest rate one more..as much as you can. When that%26#039;s gone, use the money you used to give them to the next highest, and so on.



As to consolidating it and getting a lower rate? Quite frankly unless you have perfect credit or can borrow against your home, these loans are nearly impossible to get and can end up increasing what you eventually pay.



You can either take out a second mortgage against your house or refinance but this too costs money and you end up reducing your equity in your home which means that if you end up in deeper financial trouble, your house payment will be higher and you could risk losing your home.



If you%26#039;re really in trouble, meaning starting to pay late or struggling, then there are credit counseling agencies that can help you get out of trouble faster and usually reduce the fees and interest rates on your cards.



If you look into one of the credit counselors, look for one acredited by the NFCC (see link below). Some of the companies doing this are crooks that will keep a month or more of payments for themselves, then charge high fees. The good ones don%26#039;t. So the old account will have a zero balance on it, and you can%26#039;t get any better than 0% utilization. They also look at total utilization: they total up all your balances, and all your credit limits. 10% of your score is on credit mix. The good types of credit are mortgage, secured car installment loan, prime (unsecured) major credit card (MC, V, AmEx, Disc) and store cards (Macy%26#039;s, Home Depot, etc.). The bad types of credit are payday loans, personal-finance loan accounts for purposes of cash advances, still-secured credit cards and overdraft loans. But if you have more than 6 open cc accounts, close still-secured credit cards first, if you can%26#039;t convert them to unsecured accounts (call the cc company, and make sure they waive all fees permanently, and return your security deposit with interest, otherwise close them). Super sub-prime secured accounts can be derogatory to your score (credit mix), unless you%26#039;re still young and used one to obtain your first credit.



Keep your old open cc accounts healthy by making one small, NECESSARY purchase (one purchase of groceries, gasoline or a utility bill on autocharge to the cc) each month and using auto-pay to pay it off in full the next month. No finance charges necessary to score max FICO points for the 35% of your score that is for payment history. Just purchase your way, once each billing period, to a small positive balance, and pay if off in full after the bill arrives, before the due date. For the 5th or more card, if it%26#039;s old and open, just use it once every 5 or 6 months to keep the creditor from closing it for lack of use. Your score can be penalized for your having too many open accounts that have a positive balance.

I%26#039;m trying to pay some cards down, so I set up autopay with my online banking to pay a certain amount every month. Of course you must select an amount the is more than your minimum payment. This way you won%26#039;t ever be late and have a late fee. Also if you get an offer of low APR for a set amount of time I%26#039;d take it, since it%26#039;s the interest that kills you. You can transfer your higher rate balances to the low APR rate card to work on paying it off. You have to be careful not to ever be late or you lose the good rate. Lastly, make up your mind not to keep charging until you get the balances down where you are comfortable.

Also if your wifes name is on the credit card debt even as an authorized user (only if she made charges as an AU...even a 10 cent pack of gum counts) then she would also have to file bankruptcy to get the debt under the repayment plan.



The good news is that the repayment plans are a fraction of what you owe usually and you don%26#039;t accrue intrest while under the plan. You also should be aware that you are required under the new laws to complete 6 months of credit counseling in order to qualify to file bankruptcy.



When you file you do reaffirm on your home...so it would be as if you never filed bankruptcy on your home.

But if you file a chapter 13, you%26#039;d pay the equity in rather than lose the house. None of your credit cards could get a lien on your house unless they get a judgment and file it with the county clerk before you file.



AND YES, credit cards ARE dischargeable. Don%26#039;t let anyone tell you otherwise, when your bankruptcy is over you only pay on secured debts that you want to keep the collateral for, and nondischargeable debts like taxes and student loans. Credit cards don%26#039;t get that privilege unless they prove you committed fraud.



You should consult a bankruptcy attorney about whether it is a good idea to file with your house. If there is no equity and you are current it should not impact your house, but you really need to consult an attorney about this. If your wife doesn%26#039;t file and isn%26#039;t on any of the debts, she should be okay, BUT don%26#039;t go transferring lots of assets to her name just before filing. That is fraud, and a federal crime.



If you are honest about listing your assets and debts and follow your attorney%26#039;s instructions whether for a chapter 7 or chapter 13, you will get your discharge. If you have no job, a chapter 13 will not be possible, but if you cannot exempt most of the value of your home, a chapter 7 is a very bad idea.



Also, bankruptcies can stay on your credit report up to 10 years, though you can file again after only 8 years between chapter 7s, 6 years between a 7 and a 13 and 4 years between 13s.
