As a married couple, you might choose to share bills and therefore share the responsibility or paying off debt. But in the event that your marriage dissolves, each person will be responsible for whatever debt they incurred BEFORE you were married. If you have concerns about debt (either yours or his), then the best thing to do is sit down and create a plan for getting out of debt that you are both comfortable with. You are marrying this person, so in a broader sense, his problems become yours- it%26#039;s up to both of you to work it out together. Get a plan in place before you get married, so you both have reasonable expectations. This will prevent you from becoming resentful of each other.

If they have, file a police report ASAP. You%26#039;ll need the documentation to fight the identity theft.



When the collection letters start mark them, %26quot;addressee not at this address / return to sender%26quot; and send them back to the collection agencies. The post office will do this for free of you have not opened the envelopes.

A write off is just that - they have written the debt off as uncollectible. Do not let anyone tell you anything else. I%26#039;ve been there. Contact the company you originally owed and let them know that you will not stand for the harassment. The cannot legally collect a debt they have written off.

Well first off anybody can sue anyone, the real question is whether they have a valid claim and whether they will actually go to the courts.



Here%26#039;s a strategy you might consider.



Probably better that you talk with the creditor than your wife, since you had nothing to do with the original purchases that created the debt.



every time that they call you, don%26#039;t acknowledge or disavow the debt. Say that of course if you actually owe the money then you will want to take care of it, but that you will need them to demonstrate that the debt is valid.



Press them to demonstrate in excruciating detail that the debt is valid. credit card statements, and individual transaction receipts.



Say that you need this because you have to make sure that their claim is valid.



They won%26#039;t have this information, and will eventually go away.

They can try to collect as long as the choose to, a write off is just a tax issue so they don%26#039;t pay tax until they collect. They don%26#039;t sell the debt (you would have been notified and they would no longer bother you), they have a collection agency working on their behalf to collect the debt. (collection agencies get a portion of the money they collect)They can sue one or the other party or both names on the contract. You can only sue the ex for half after they sue you.



Will they sue?...depends on the amount owed, and if you have any assets. If you have no assets, chances are slim that they will waste the resources to get a judgment against someone who has no money.

I have a judgment against me from the second mortgage holder on an investment house I bought that was foreclosed on. The first mortgage company foreclosed and sold the house (in Nevada) at auction. Your first meeting with him/her is usually free, you can get references from attorneys that don%26#039;t handle bankruptcies so ask your friends for a name of a good lawyer, then call them and ask them to refer you to a good bankruptcy attorney. If you have alot of assets......non retirement assests (because those are protected), then you may have to file chapter 13 which would help you reorganize your debts and set up a plan to pay them back at a reduced amount and interest rate. Yes, unfortunately they can take you to court. However, this is not a criminal court, and you don%26#039;t even have to turn up if you don%26#039;t want to.



Basically you end up with a CCJ, and the judge orders you to pay. It ruins your credit rating! You can put in a defence though with your incoming and outgoing money, and the judge will only order you to pay what you can afford, can be as small as 鎷? a week! So sometimes, although it ruins your credit, it can be a blessing, as you are ordered to pay less than what the credit card company would want you to pay.



It is better to try and make an arrangement with the company yourself though, and save your credit rating. Its not really worth companies taking you to court for small amounts of money, but they threaten it to try and get you to pay. I`m sure that you can come to a private repayment arrangement at a monthly fee you can afford. If you set this up though, its VITAL that you stick to it!



Go to the CAB and they should be able to help you to organise your finances and sort out arrangements with your lenders.

Firstly, well done you, for facing this and handling it even though you are so ill. You are handling things the right way, they could take you to court if they wanted to, but would look pretty stupid as you have offered monthly payments and you are paying your creditors back. Having been in exactly the same situation as you, I can tell you the thing to do would be to visit your local Citizens Advice Bureau and take all your paperwork with you and let them help you. They know the law, and what the minimum payments you could make, which may buy you a little more money after creditors are paid off. They are non-judgemental and really helpful, explain everything to them and you won%26#039;t be sorry you went to see them, they will put your mind at rest.



I can also recommend having some Cognitive Behaviour Therapy for your depression. I was dogged with severe depression for over 20 years, I had all kinds of treatments and therapies, all to no avail, but I had six sessions of CBT two years ago and have not been depressed since, it gave me control over my life again, your doctor should be able to refer you. They don`t take people to court usually for a sum less than 鎷?000. Go to moneysavingexpert.com there`s loads of advice on there from people who have been in debt. You can see a debt advisor at citizens advise for free. they will negotiate with these companies for you, personally i think they will negotiate that you will pay far less than you have offered considering your income.



The worst that happens if it does go to court (and it`s only county court) is that you will offer to make repayments and the y will have to accept it. Don`t worry nothing ever turns out as bad as you think it will. Theses people are employed to threaten and bully you, they get bonuses for it!

You might consider a consumer credit counselling service. Such services will take the info on your debts and income and try to work out deals with your creditors for you, and help you come up with a budget as well. Just be sure that you don%26#039;t use one that will want to loan you money, and check with your state%26#039;s attorney general%26#039;s office to see if your state licenses credit counselling organizations. Many are not reputable.

No court in England will order you to pay back more than you can afford, and also if it does go through court, any interest being charged will be stopped. I would reply to your creditors pointing out all this , along with your monthly incomings/outgoings and also point out your other creditors have been happy to accept your offers. Hire a GOOD lawyer. This one is a federal case. Once the charges are filed, have the lawyer fire off a letter to the collection agency informing them that they are attempted to collect money that was fraudulently billed, and if they continue to persue the matter, they will be also charged in the lawsuit as accesories to the crime. They will probably drop everything and run away as fast as possible from your case. If they done, just have your lawyer serve THEM with papers too and dont settle with the collection agencies unless they pay YOU big bucks.

The reason why the debt buyer bought the debt for less than the full amount was because the seller did not know whether or not you would pay the full amount. Therefore, they decided to cut their losses and settle for a sure payment from a third party, even though it was for less than the face value of the debt... it%26#039;s a shame that the credit card company didn%26#039;t offer the same dollar amount to you!!! (but then again credit card companies are evil, so why would they have done something nice for you?)



Unfortunately, the amount for which the debt buyer bought your account for will probably not matter in a court of law (unless you have a REALLY good lawyer, which you can%26#039;t get for less than the $1,500 unless they take the case pro-bono). However, it might gain sympathy from the judge.



Why not try to settle out of court with the debt buyer? Call them and tell them that they have not disclosed their terms of payment to you and therefore are in violation of state and federal law, however, that you will pay them $1,000 over ten months in order to avoid taking them to court... it saves them that $500 from having to pay a lawyer, and it makes the outcome slightly more reasonable for you.



Or, if that doesn%26#039;t work, try finding a group that will take your case pro-bono (it%26#039;s when a lawyer takes a case for free because it%26#039;s a good cause or an exciting/benchmark case). Everyone knows that credit card companies and their ilk are evil (Chase is the worst!!!). Try and find someone that wants to charge them with profiteering, exhorbant rates, etc. But that isn%26#039;t a case you can make using advice from yahoo users (no offense to you or me).



Your best option is to try to settle out of court for an amount closer to what they bought the debt for or you can try and find a group to take your case pro-bono.
